By using https://creativedress.eu and / or by placing an order, you are obliged to comply with the terms and conditions specified below (“Terms”). Before placing an order, please make sure that you have read and understood the Terms.
By using the site https://creativedress.eu and / or by placing an order and / or creating an account, you are obliged to comply with the “Privacy Policy” and “Cookies Policy”). Before placing an order, please make sure that you have read and understood our policies in the field of protection of your personal data. At the same time, we explain that your express consent is required (not mandatory) for the collection and processing of your data (name and surname, home / residence address, email, telephone number), in order to complete and deliver orders.
Only persons with a minimum age of 16 years (who are not under guardianship) and who have a home address or other address in Romania, can place an order.
The inclusion of any products or services on https://creativedress.eu at any time does not imply or guarantee that these products or services will be available at any time. We reserve the right to cease marketing a product at any time.

Personal data means any information that may be linked to an identified or identifiable natural person (subject person). Personal data includes all types of direct or indirect information (ie used in connection with other data) that relates to the subject person, such as name, date of birth, addresses, e-mail addresses, telephone numbers, etc.

- Contact details – Name and surname, billing address, delivery addresses, telephone numbers, email addresses

- authorities, public institutions, other parties: on the basis of necessity, insofar as it is a legal obligation
- accountants, lawyers, auditors, external consultants: based on necessity, respecting confidentiality
Users of our platform, who wish to benefit from our services and provide us with information, may be asked to provide personal data so that https://creativedress.eu can operate orders and improve services and business.
We collect, first of all, personal data such as: name and surname, date of birth, domicile / residence address (for delivery of orders), e-mail addresses, telephone numbers and in case of returns of orders and bank account (to transfer money). The purpose of collecting personal data and the legal basis for their processing The purpose of data collection is to be able to provide you with our services, to provide you with support for your orders, to inform you of changes in our services and any new services that we or our partners offer. Therefore, the collection of your personal data has its legal basis in both laws, both applicable at national level (domestic law) and applicable in European law and provides that the processing is necessary for the execution of a contract to which the data subject is a party or to take steps at the request of the data subject before concluding a contract ”(art. 6 of the GDPR). You are not required to provide the data, but it is necessary to complete and deliver an order. In this regard, your consent to the collection of data by us must be explicit and free, unconditional and expressed in clear and simple language. We also collect personal data for other purposes, such as: informing you about the latest promotions, exclusive discounts for subscribers and the latest products added, our campaigns and information about the latest clothing trends (direct marketing), as well as for the optimization of orders and deliveries, for the promotion of new product categories and for the granting of facilities / discounts, based on statistics and order history. We will process personal data only for specified, explicit and legitimate purposes or, in exceptional cases, for other purposes required by Romanian law or by the authorities.
Your rights
According to the General Data Protection Regulation (“GDPR”), you benefit from the right of access, intervention on data, the right to be informed, the right not to be subject to an individual decision, the right to request the porting of your data, and the right to go to court. At the same time, you have the right to oppose the processing of personal data or to restrict the processing of data concerning you and to request the deletion of data, and you will be forgotten.

The right to rectification. The data subject has the right to obtain from Creative Dress, without undue delay, the rectification of inaccurate personal data concerning him and the completion of those data that are incomplete.
The right to data portability. The data subject has the right to receive personal data concerning him or her which he / she has provided to us in a structured format and to transmit this data to another controller. The data subject has the right to have this data transmitted directly to another operator, if this is technically feasible.
The right to withdraw consent. The data subject has the right to withdraw his / her consent to the processing of personal data at any time, if the processing is based on consent. Withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of the consent before its withdrawal.
The right not to be subject to an automatic decision. The data subject has the right to oppose a decision based exclusively on automatic processing, including the creation of profiles, which affects him to a significant extent. In this case creativedress.eu will re-evaluate this decision through a human operator, giving you the opportunity to express your point of view and challenge the decision.
The right to delete data (“the right to be forgotten”). The data subject has the right to obtain the deletion of personal data concerning him / her, without undue delay, in the situations provided by law (for example when the data are no longer necessary for the purpose for which they were processed, to withdraw consent or to oppose the processing). , or if it is found that the processing was not lawful).
The right to opposition. The data subject has the right to object to the processing of personal data concerning him / her, including the creation of profiles, when the processing is based on the existence of a legitimate interest of Creative Dress. You have the right to request at any time access to the rectification, deletion or restriction of the processing of data collected by us. Use of personal data, access, rectification or deletion of data and storage period
We will use personal data only for the purpose for which it was collected and we will store the data only to the extent necessary for that purpose.
Access to personal data is authorized only for the staff of the operator and the courier (in order to be able to deliver orders), and they have the necessary authorization and the clearly defined need for the use of data.
We will retain the client’s information for the period in which his account is active, to provide services, to comply with our legal obligations or for any of the purposes mentioned above.
In the conditions in which the deletion of the client account is requested, an unmotivated request is addressed to the operator, by email address: gdpr@creativedress.eu or by mail to Strada Domneasca 105, Galati and closing the account and deleting the data will be done in maximum 30 days from the date of request. Disclosure of personal data Personal data will not be disclosed to third parties, except in cases where disclosure is necessary in order to provide our services. Service providers will be allowed to obtain only the personal data necessary to deliver their services.
Security of processing We will process the data securely, apply and maintain appropriate technical measures to protect personal data against accidental or unlawful destruction or loss, alteration, disclosure or unauthorized access, especially when the processing involves the transmission of data over a network, as well as against any other form of illegal processing.
Responsibility The Creative Dress team is responsible and will be able to demonstrate at all times compliance with the GDPR as well as with the principles set out in this document and, where necessary, make the information available to the supervisory authorities. Claims You have the right to request information from us and to address any complaints related to the processing of your personal data. All questions and complaints will be processed by us, in a timely manner and in accordance with internal procedures, and within a maximum of one month, you will receive an answer.
According to art.12 paragraph 5 of the GDPR: “If the requests from a data subject are clearly unfounded or excessive, especially due to their repetitive nature, the operator may: a) or to charge a reasonable fee taking into account the administrative costs for providing information or communication or for taking the requested measures; b) or to refuse to comply with the request. ” In the unlikely event that customers have suffered damages due to the violation of their rights, according to the personal data protection policy and Creative Dress has not handled the complaint properly, customers have the opportunity to send a complaint to the higher authority. At the same time, the operator has the obligation to notify the supervisory authority, within a maximum of 72 hours, from the moment of violating the security of personal data.

We encourage customers to check this page periodically to be informed of the latest news regarding our privacy practices. Our company cannot be held liable for any damages caused to you as a result of non-fulfillment of orders, for reasons beyond our control. Adding a product to the shopping cart, in the absence of completing the order, does not entail the registration of an order and implicitly also the automatic reservation of the product. After completion, the order details can be checked in the confirmation message. The conditions for concluding and executing distance contracts between us and you – individual clients are regulated by Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals.
If you place the order / acquisition as a legal entity, authorized natural person or individual / family enterprise, the provisions of Emergency Ordinance no. 34/2014, but the common law norms of the Civil Code.
Prices and delivery fees
The prices are those displayed on https://creativedress.eu when we receive the order from you (except in the event of an error) and include the value added tax provided by law, but do not include the delivery fee .
All prices displayed are prices in lei (EUR). The prices of the goods displayed and ordered through the platform https://creativedress.eu may differ from the prices in the workshop or showroom.
For orders that are paid online with the card, delivery is Free. For orders that are paid on delivery, the shipping cost is xxxxxxx EUR.
If we discover an error in the price of the products you have ordered, you will be informed as soon as possible and you will be given the opportunity to reconfirm the order with the correct price or to cancel it. If we cannot contact you, the order will be treated as canceled. If you cancel the order before shipment, but you have already paid for the products, the amount paid will be refunded in full.
Colors
We make every effort to correctly display the features of our products, including composition and colors. The color you see will depend on your computer system, and we cannot guarantee that your PC will display these colors correctly.
The right of withdrawal and return of products
According to the legislation in force (GEO no. 34/2014), the waiver of the purchase (right of withdrawal) is applicable only to individual customers and only in the case of the contract concluded at a distance between you and us.
You have the right to inform us in writing – by email or by the withdrawal form received in the order or by the withdrawal form displayed on the website https://creativedress.eu – that you give up the purchase, without penalties and without invocation for a reason, within 14 calendar days from the receipt of the product (art. 8 and art. 11 of GEO no. 34/2014).
The return of the products is made ONLY BY COURIER at the address: Strada Domneasca 105, Galati, recipient SC NAVEXIM SA.
The transport cost, in case of returning the products, is free of charge if you use the courier company that delivered the product and mention “payment for transport to the recipient”. Returns mentioning “cash on delivery” or “delivery payment” will not be received.
IT IS NOT POSSIBLE TO RETURN PACKAGES PERSONALLY TO THE COMPANY’S HEADQUARTERS OR TO THE ADDRESS FROM Strada Domneasca 105, Galati or to any of our showrooms.
If you choose a courier other than the one who delivered the products, you will bear the cost of return.
We will refund the money, in the account mentioned in the return form, within 14 calendar days from the confirmation of the return. Art. 13 paragraphs 1 and 4 of GEO no. 34/2014 state that: “The professional reimburses all amounts received as payment from the consumer, including, as appropriate, delivery costs, no later than 14 days from the date of receipt of the products that were the subject of the sale (in case of sales contracts) ”
We do not accept the return of damaged, soiled, washed, modified or worn products (except for their proof) and all labels must be intact. Please return the products in the condition in which you received them, accompanied by the invoice and the return form.
In the event that we find the decrease in the value of the products, resulting from their improper handling, we reserve the right to notify you and request the payment of an amount corresponding to the decrease in value suffered by the product.
Warranty and claims
If the goods you have purchased are defective, NAVEXIM SA complies with all regulations provided by law on warranty (Ordinance no. 9/2016 amending and supplementing Law no. 449/2003 on the sale of products and associated guarantees).
If you have a complaint about the obvious defects in material or workmanship of the goods we have supplied, including any damage suffered during transport, please let us know.
Any complaint must be made by e-mail or telephone number specified in the “Contact” section of this site or by using the return form. The notification must contain a description of the claimed defect and a copy of the invoice (or any other document proving the acquisition). Any notification will be processed without delay and the client will be informed about the findings made.
The return of the products is made ONLY BY COURIER at the address: Strada Domneasca 105, Galati, recipient SC NAVEXIM SA.
All ordered products benefit from the guarantee offered by each manufacturer. The products sold by us are not counterfeit. Please read and follow the instructions on the product label!
The products will be returned in the original packaging, with unbroken individual labels, accompanied by the tax receipt or VAT invoice and the return form.
You have the right, according to Ordinance no. 9/2016, to request the repair or replacement of the non-compliant product, within a period of time that will not exceed 15 days from the date on which you returned the product to us. At the same time, you have the right to request a refund.
In the case of clients of legal entities, you will bring to our attention any complaint regarding the products that have been delivered to you, within a maximum of 24 hours from the receipt of the products, and this will be sent to the supplier of the respective products, for solution.
Failure to pick up the ordered packages or return them repeatedly will be considered abuse, and our company reserves the right to refuse future orders from the customer.

Termination of some terms
If any part of these Terms is prohibited or deemed ineffective by any court or regulatory body, the other Terms will continue to apply.
Property rights
All intellectual property rights, such as trademarks and copyrights on https://creativedress.eu, belong to SC NAVEXIM SA. Any use of the https://creativedress.eu site or its content, including copying or storing all or part of the content (pictures, product descriptions, etc.), for any purpose other than for your personal and non-commercial use, is prohibited without the written permission of SC NAVEXIM SA. If you notice a possible violation of the transport right provided by the courier or the signing of the receipt on the fiscal invoice in case of deliveries made by the Seller’s staff).
Our responsibility
Nothing in these Terms shall exclude or limit SC NAVEXIM SA’s liability in respect of any matter for which it would be unlawful to limit or exclude our liability.
Our maximum liability to you for any loss or damage that occurs in connection with your order on https://creativedress.eu will be limited to the total price of your order.
Major power
Neither party will be liable for non-performance of its obligations if such failure to perform on time and / or properly, in whole or in part, is due to a force majeure event. Force majeure is the unpredictable event, beyond the control of the parties and which cannot be avoided.
